By commissioning work, you agree to the following Terms and Conditions. These terms outline the nature of the service provided, payment terms, intellectual property rights, and other important information related to commissioned work.
Requesting a Commission: To request a commission, you must contact Colin Crisostomo (Ragiscal) via ColinJCrisostomo@gmail.com and provide all necessary details about the project, including but not limited to the type of artwork, size, and any references or inspirations.
Quotation and Agreement: Once the details are confirmed, an estimate will be provided based on the complexity and scope of the work. A formal agreement outlining the cost, timeline, and specific details of the commission will be created. The commission will not begin until the agreement is made and the commission fee is paid.
Deadlines: The estimated time to complete a commission will be provided after the agreement is made. While every effort will be made to meet deadlines, delays may occur due to unforeseen circumstances.
Commission Fee: A non-refundable deposit of 50% is required before work begins. This payment ensures that the commission slot is secured and covers initial work.
Final Payment: The remaining balance is due upon approval of the final draft or before the artwork is delivered. If the final payment is not received within five days of completion, the artist reserves the right to withhold delivery of the artwork.
Payment Methods: Payments are accepted via [bank transfer, zelle, and venmo]. All payments must be in US dollars.
Initial Drafts: The artist will provide an initial draft or concept for approval. You are entitled to three revisions within the scope of the original agreement. Any major changes beyond the initial concept may incur additional fees.
Final Approval: Once the final version of the artwork is approved by the client, no further revisions will be made without additional costs.
Format: Completed artwork will be delivered in digital format.
Delivery Time: Once the final payment is received, digital work will be sent within three business days.
Artist's Copyright: The artist retains full copyright over the artwork unless otherwise agreed in writing. The client is purchasing the right to use the artwork for personal or commercial purposes, as specified in the agreement.
Licensing: If the client intends to use the artwork for commercial purposes, a separate licensing agreement may be required.
Credit to the Artist: When displaying the commissioned artwork publicly (online or offline), the client agrees to credit the artist with a visible link or mention where applicable.
Cancellation by Client: If the client decides to cancel the commission before the artwork is started, the commission fee will be forfeited. If the commission is cancelled after work has begun, the commission fee will not be refunded. Whether the incomplete work is given to the client will be determined by the artist (Colin Crisostomo).
Cancellation by Artist: The artist reserves the right to cancel the commission if they are unable to complete the work due to personal, technical, or health reasons. In such cases, the client will receive a full refund of any payments made.
The artist will respect the confidentiality of any private information shared during the commission process. Similarly, the client agrees not to disclose or share the artist’s confidential processes, sketches, or drafts without the artist's consent.
The artist's style is unique, and all commissions will reflect the artist's aesthetic vision. The artist will make every effort to understand and incorporate the client’s preferences, but final artistic decisions will remain at the discretion of the artist.
In case of any disputes related to the commission, both parties agree to resolve the issue through mediation or arbitration before seeking legal action. Both the client and artist agree to work in good faith to resolve conflicts amicably.
The artist reserves the right to modify or update these Terms and Conditions at any time. Any changes will be communicated to the client prior to the start of a new commission.
